These Terms of Use ("Terms") are an agreement between you and MJ Audio ("MJ Audio", "we", "us"). They apply to the MJ Audio mobile application (the "App") and to our website at mjaudiopro.com.br, mjaudiopro.com and mjaudio.com.br (the "Website"). By installing or using the App, or by using the Website, you agree to these Terms. If you do not agree, do not use the App or the Website.
1. The App
The App is a companion for compatible MJ Audio speakers. It lets you connect to a speaker over Bluetooth and adjust its settings, such as volume, equalizer, effects and lighting. The App requires a compatible MJ Audio product; it does not play or process audio on its own.
2. License
MJ Audio grants you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for the purpose of operating compatible MJ Audio products, in accordance with these Terms and the rules of the app store you downloaded it from. If you downloaded the App from the Apple App Store, Apple's Licensed Application End User License Agreement also applies, and in case of conflict, these Terms prevail to the extent permitted.
3. What you may not do
- Copy, modify, distribute, sell or rent any part of the App, or reverse engineer, decompile or attempt to extract its source code, except where the law expressly allows it.
- Use the App to control products you are not authorized to control.
- Use the App in a way that could damage, disable or impair MJ Audio products, or interfere with other users.
- Remove or alter any proprietary notices in the App.
4. Use at safe volumes
The App can set your speaker to high volume levels. Prolonged exposure to loud sound can damage your hearing. Use the App responsibly, keep volume at safe levels, and follow the safety instructions that come with your speaker. You are responsible for how you use the products you control with the App.
5. Firmware updates
The App may offer firmware updates for your speaker. Updates are provided to improve performance, compatibility or security. Follow the on-screen instructions and do not turn the speaker off during an update. MJ Audio is not responsible for problems caused by interrupted updates or by use of modified firmware.
6. Updates and availability
We may update, change or discontinue the App or any feature at any time. The App may stop working with older phones, operating system versions or products. We are not obliged to provide maintenance or support, although we will do our best to help you through our support page.
7. Intellectual property
The App, the Website and their content (including the MJ Audio name and logo, text, images and software) are owned by MJ Audio or its licensors and are protected by intellectual property laws. These Terms do not give you any right to use MJ Audio's trademarks.
8. Product information on the Website
The Website presents MJ Audio products for information only. Specifications, availability and images may change without notice and may differ from the product you receive. The Website does not sell products; purchases are made through authorized dealers, whose own terms apply.
9. Disclaimer of warranties
The App and the Website are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be error-free, uninterrupted or compatible with every device. This section does not affect the product warranty that applies to MJ Audio hardware, which is provided separately with the product, nor any rights you have under applicable consumer law that cannot be excluded.
10. Limitation of liability
To the fullest extent permitted by law, MJ Audio will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or related to your use of the App or the Website. Our total liability for any claim relating to the App or the Website will not exceed one hundred US dollars (US$100). Some jurisdictions do not allow these limitations, so they may not apply to you.
11. Termination
You may stop using the App at any time by uninstalling it. We may terminate or suspend your license if you breach these Terms. Sections 7, 9, 10, 12 and 13 survive termination.
12. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction, except where applicable consumer law gives you the right to bring a claim where you live.
13. Changes to these Terms
We may update these Terms from time to time. The date at the top shows when they were last changed. Continuing to use the App or the Website after a change means you accept the updated Terms.
